Draft: attorney review pending United States · English source stamp 3bc977fca248

DRAFT — NOT LEGAL ADVICE. Attorney review required before use.

TEMPLATE. Draft for ViaVela Solutions LLC for ViaVela Machina (DiagAI). Have a licensed attorney review before publishing. Fill every bracketed […] item and delete this banner first. Written against the Machina codebase as of 2026-10-25 (workbench source fc72e08 plus the shop-management module in development). Revised from the 2026-08-18 text, which described offline-only software: since 2026-10-18 the Software looks vehicles up online by default and works offline only when the connection fails (owner decision). Sections 2, 4 and 5 must change whenever the Software's connections or stored records change.

ViaVela Machina Privacy Notice

Last updated: [DATE — fill before publishing]

Machina is desktop software that runs on your own computer. It normally uses the internet to identify vehicles and keeps working on its own when the connection drops. ViaVela Solutions LLC runs no Machina service: nothing the Software records is sent to us.

1. We do not collect your data

ViaVela Solutions LLC does not collect, receive, or have access to:

  • your diagnostic sessions, trouble codes, freeze frames, or live data;
  • the vehicles you work on, your customers, or your shop records;
  • your notes, chat history, or reference library;
  • usage analytics or telemetry of any kind.

There is no account, no sign-in to a ViaVela service, and no remote access to your installation.

2. Where your data lives

Everything the Software records is stored on your own machine, in the library folder the Software was installed with:

  • diagnostic cases — scan captures, VINs, trouble codes, symptoms, evidence and notes;
  • vehicle identifications already looked up (Section 4), so they still work offline;
  • shop records you enter — customers (name, phone, email and notes), their vehicles (VIN, plate, mileage and similar details), parts and stock, and work orders with their history;
  • the log of every active-test request the Software sends to a vehicle;
  • the local AI's chat history and any reference material you import.

You control these files, you back them up, and you delete them by deleting the files. The Software can export a case and your shop records so you can keep or hand over a copy. [Counsel: the shop module cannot yet delete a single customer record from inside the Software — see the change log.]

3. The AI runs locally

The AI assistant runs on your machine through a local model runtime. Vehicle data, case content and chat content are not sent to a cloud AI service.

4. Connections the Software makes

  • Vehicle identification (on by default). When a scan reads a vehicle's VIN, the Software sends that VIN — and nothing else from the case — to the U.S. National Highway Traffic Safety Administration's public vehicle-decoding service (NHTSA vPIC) and saves the answer locally. You can turn the lookup off for a scan; the scan is then saved with the VIN only.
  • Connection check. While the Software is open it asks the same NHTSA service, at most once a minute, whether it is reachable. This check sends no VIN and no case content.
  • Recall and complaint research. When you ask for it, the Software sends the selected year, make and model — not the VIN or your customer — to NHTSA's public recall and complaint services.
  • Wiring diagrams and manuals. A local server you run, or a hosted source you configure. That source sees your requests and its own terms apply.
  • Model downloads. When you choose to download an AI model, that download comes from the model host.

NHTSA and the other parties above see each request, including your computer's network address, as with any request from your computer, and their own policies apply. ViaVela does not receive a copy. [Counsel: confirm whether a VIN sent alone is personal information in each state of distribution.]

5. Your customers' information

Customer and vehicle-owner details you record — in the shop records or in case notes — stay on your machine and remain your responsibility under whatever privacy law applies to your business, including answering a customer who asks to see or delete their information. ViaVela is not a processor of it, because we never receive it. Keep the computer and its backups secure.

6. Changes

We will update this notice if the Software's behaviour changes, and revise the date above.
